The Biggest Non Issue Of The Day?

By Justin Gardner | Related entries in Supreme Court

The left-wing blogosphere is buzzing with “John Roberts” and “Federalist Society.” Abuzz, abuzz, abuzz…

Here’s what the wikipedia entry on the Federalist Society has to say:

The 2005 Supreme Court nominee John G. Roberts, Jr. was also reported to be a member, but there was uncertainty about this fact when Dana Perino, White House spokeswoman, said, “He has no recollection of ever being a member.” [2]. However, The Washington Post later located the Federalist Society Lawyers’ Division Leadership Directory, 1997-1998, which listed him as a member of the Washington chapter steering committee, although, membership in the society is not necessarily required to be listed in the “leadership directory.” Furthermore, no confirmable membership information has been disclosed at this point.[3]

So why are they buzzing? Because Clarence Thomas and Antonin Scalia are members and they’re seen as the most convservative justices on the court. And some see them as the most activist judges too.

However, I think that Roberts seems to be above all of that and if he says he’s never been a member, then why not just trust him? Why would he lie? It’s going to come out eventually.
