I've purchased two properties - one condo and one townhouse. Neither was anywhere near sea level or any significant body of water. There were giant disclaimers all over the mortgage stuff which required me to acknowledge that I wasn't covered for flood.

If the lawsuit will change this, and make flood similar to fire or earthquake, I'm in favor of it. If it's just another perverse disincentive, I'm against it.

Anecdote - even though I'm not on a flood plain, I did actually have two floods last year - one was a backed up sewer line, and the other was a blocked drain. Thank Heaven the basement is unfinished...

Very true, Kreiz -- why does the government insist on subsidizing flood insurance and encouraging people to build their homes in flood plains? I haven't gotten a satisfactory answer to this question yet.

Why would a Gulf resident ever purchase flood insurance if they knew that they could avoid the premium payments and still be covered? There's no incentive to do so.
