Maybe. Some may even call it fodder for impeachment/removal from office. If the congress wanted to stop this they would: cut the funding. They won't, obviously, for political reasons, and the fact that short of "cut and run", they don't feel they have many options at this point, what with the "threat" from Iran (who we'll likely "accidentally" bomb, like we "accidentally" bombed the Chinese embasy in Bosnia in the late 90's) Anyway, I'm looking forward to the day this administration finally leaves office, hopefully replaced by better men and women than these.
