		<description>I&#039;m a little more optimistic that &lt;i&gt;Kelo&lt;/i&gt; will be overruled sooner rather than later. Only four of the five remain on the court today, and these kind of practical consequences can be used to appeal to Justice Breyer. I don&#039;t know Justice Sotomayor&#039;s position, but given the broad, bipartisan consensus that &lt;i&gt;Kelo&lt;/i&gt; was misbegotten and wrongly-decided, I am hopeful that she has a dispute with it, too. I think the feeling that a mistake was made may be strong enough to attract a cert grant even absent a circuit split, and a well-framed case could expurge &lt;i&gt;Kelo&lt;/i&gt; swiftly.</description>
