I generally don&#8217;t post here about the day to day indignities foisted upon the San Francisco citizenry by our Board of Supervisors. However, since this local edict has garnered Daily Show treatment, I thought I&#8217;d bring it to your attention.   My hometown Board of Supervisors have again set up The City for national ridicule and general hilarity, this time with the<a href="http://eater.com/archives/2011/01/04/kids-call-sfs-happy-meal-ban-the-worst-thing-ever.php"> ban on Mcdonald&#8217;s Happy Meal toys</a>. I guess it is a good thing that in these trying times we can offer ourselves up to the rest of the nation as civic clowns to help lighten the national mood.</p>
<p>I fully understand that  &#8211; in the most progressive major city with the most progressive governing body in the country &#8211; it is impossible to resist the temptation to occasionally legislate based on their core belief that no citizen can make a decision for themselves or their family without the Supervisors benevolent dictates <strike>guiding</strike> forcing them to &#8220;do the right thing&#8221;. But &#8211; when even the Daily Show is pointing and laughing &#8211; you&#8217;d think <a href="http://blogs.sfweekly.com/thesnitch/2010/12/happy_meal_daily_show_eric_mar.php">our Supes</a> might get a clue.</p>
<p>Featured in the clip is SF Supervisor <a href="http://www.sfbos.org/index.aspx?page=2083">Eric Mar</a> as he is made to <a href="http://sfist.com/2011/01/04/here_is_eric_mars_the_daily_show_ap.php">look particularly stupid</a> by Daily Show comedian Asaif Mandvi.  It&#8217;s not like that is a difficult thing to do with our Board of Supes, but Asaif dishes it out with an extra helping of much deserved derision. I can only hope that Mar&#8217;s decision to appear on The Daily Show was a career limiting move. </p>
<p>Our local fishwrap <a href="http://www.sfgate.com/cgi-bin/blogs/cityinsider/detail?entry_id=80277&amp;plckItemsPerPage=10&amp;plckSort=TimeStampAscending">transcribes the funniest bit</a>:<br />

Those opposed to the to ban maintain it&#8217;s up to parents, not McDonalds, to ensure their kids learn healthy habits. </p>

<strong>Mar:</strong> &#8220;That&#8217;s a large part of it.&#8221;<br />
<strong>Mandvi:</strong> (staring in wide-eyed disbelief) &#8220;Would it be hard to pass a  law to force Netflix to send &#8216;Super Size Me&#8217; to every parent in San  Francisco?&#8221;<br />
<strong>Mar:</strong> &#8220;We can&#8217;t force Netflix, a private company, to do something like that.&#8221;<br />
<strong>Mandvi:</strong> &#8220;Are you serious right now?&#8221;<br />
<strong>Mar:</strong>&#8220;We have no power to force Netflix or a private company like that to change a business practice.&#8221;<br />
<strong>Mandvi:</strong> &#8220;So on one hand, you&#8217;re like, &#8216;We can&#8217;t do that&#8217; but on the other hand, you are doing that.&#8221;</p>
<p>Mar, looking very tired, shakes his head, stumbles over one of the  progressive supervisor&#8217;s favorite words, equitability, and mercifully  the interview ends. Oy.&#8221;</em></p></blockquote>
<p>The good news is that <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/01/02/BA8A1H1R6E.DTL">four of our Supes have termed out</a> and will be leaving office this week. The bad news is that Eric Mar is not among them.</p>

<p>Jan Brewer&#8217;s <a href="http://donklephant.com/2010/09/02/jan-brewers-very-bad-debate-day/">cringe inducing debate performance</a> received more media attention, but there was another debate on Wednesday night that may have been more important. <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2010/09/02/MN9T1F7AJR.DTL">Carly Fiorina and Barbara Boxer</a> met for their first (and potentially only) debate of the election season.  It is one of the <a href="http://donklephant.com/2010/08/30/10-in-10/">&#8220;dirty dozen&#8221;</a> contests that will determine whether the GOP retakes the majority in the Senate. </p>
<p>Democrats enjoy a huge advantage in statewide California elections. In 2008, 44% registered Democratic, 31% registered Republican and 20% Independent (Decline to State).  Despite the uneven playing field, Fiorina and Boxer were polling in a dead heat going into the debate.  I generally have very low expectations for political debates, and perhaps that is why I was pleasantly surprised. </p>
<p>My impressions:  Both candidates acquitted themselves well and were very well prepared. <a href="http://opinion.latimes.com/opinionla/2010/09/senate-candidates-beg-to-differ.html">It was a good debate</a>.  A sample clip:<br />

They clearly had different objectives, and I think they both accomplished what they set out to do. With her big registration advantage, Boxer just needed to play to her base. California voters already know Boxer and her shtick. She just needed to be the senator her base expects and not make mistakes. If she can get the Democrats off their collective asses and voting in force, she should win this going away. But this year, with 60 days to go, with <a href="http://donklephant.com/2010/08/31/gallup-gop-leads-by-10-in-generic-ballot/">Democrats feeling lethargic and uninspired</a>,  that appears to be a mighty big &#8220;if&#8221;.<br />

Fiorina had more at stake in this debate, as I suspect this was the first time that many California voters started to pay attention to this election.  This was Fiorina&#8217;s chance to make a first impression on voters who do not know her well. She needed to look senatorial, competent, and in command of the issues facing the state. Debates are as much about TV, presence and image as they are about issues. From that perspective, she knocked it out of the park. She came across as smart, articulate and tough with a detailed understanding of the issues &#8211; basically a strong business woman. Fiorina could have easily blown her chances with a stumble in this debate, but instead she inspired confidence.   </p>
<p>Most <a href="http://totalbuzz.ocregister.com/2010/09/01/boxer-fiorina-wrap-up/40061/">post-mortems</a> called it close or a draw.  I&#8217;m guessing she was good enough for a bump in the polls that will put her in the lead. </p>
<p>That said, there was one major issue that has emerged in this contest that I did not feel qualified to judge.   So I asked my wife <a href="http://www.huffingtonpost.com/2010/06/09/carly-fiorina-open-mic-vi_n_606723.html">who had the better hair</a>. She did not hesitate &#8211;  Carly.  Done deal. Carly wins this round. </p>
<p>In other election news, the blogosphere was abuzz with <a href="http://www.centerforpolitics.org/crystalball/">Larry Sabato&#8217;s Crystal Ball Prognostication</a>:</p>
<blockquote><p><i>&#8220;In the Senate, we now believe the GOP will do a bit better than our long-time prediction of +7 seats. Republicans have an outside shot at winning full control (+10), but are more likely to end up with +8 (or maybe +9, at which point it will be interesting to see how senators such as Joseph Lieberman of Connecticut, Ben Nelson of Nebraska, and others react). GOP leaders themselves did not believe such a result was truly possible just a few months ago. If the Republican wave on November 2 is as large as some polls are suggesting it may be, then the surprise on election night could be a full GOP takeover. Since World War II, the House of Representatives has flipped parties on six occasions (1946, 1948, 1952, 1954, 1994, and 2006). Every time, the Senate flipped too, even when it had not been predicted to do so. These few examples do not create an iron law of politics, but they do suggest an electoral tendency.&#8221;</i></p></blockquote>

<p>Proponents and opponents of gay marriage, the end is nigh.</p>
<p>The ruling today was a thing of beauty, not just because Prop 8 was overturned, but because the language in the decision basically positions Gay Americans as equal to every other American in every single way.</p>
<p>And, the cherry on top of the judicial sundae? A Republican appointed judge wrote a lengthy repudiation of every single conservative talking point against gay marriage.</p>
<p>Why? Because the defense didn&#8217;t present any compelling reasons why Gay Americans should be denied marriage rights. In fact, in many cases during the trial they had to admit that gay marriage has absolutely no effect on straight marriage.</p>

<blockquote>&#8220;Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license,&#8221; wrote U.S. District Court Judge Vaughn Walker in a 136-page decision. &#8220;Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couples.&#8221; [...]</p>
<p>Lawyers supporting the ballot measure had argued that voters endorsed a &#8220;fundamental, definitional feature&#8221; of marriage that has historical roots &#8220;in this country and, almost without exception, in every civilized society that has ever existed.&#8221;</p>
<p>But Walker found the plaintiffs in the case &#8212; one lesbian and one gay couple &#8212; demonstrated by &#8220;overwhelming evidence&#8221; that Proposition 8 violates their rights to due process and equal protection under the Constitution.</p>
<p>&#8220;Moral disapproval alone is an improper basis on which to deny rights to gay men and lesbians. The evidence shows conclusively that Proposition 8 enacts, without reason, a private moral view that same-sex couples are inferior to opposite-sex couples,&#8221; wrote Judge Walker.</p></blockquote>
<p>Now it&#8217;s on to the Supreme Court, where it&#8217;s extremely likely that the decision will be affirmed&#8230;which will then nullify all of the state amendments that define marriage should strictly be between a man and a woman.</p>
<p>Long story short, it&#8217;s a good day for all Americans in the long run, even though many don&#8217;t think so today.</p>

<p>Like so many other laws that make it through corrupt, and usually quite partisan, legislatures or ballot initiatives, this law violates the first rule that an ethical lawmaker or political organization ought to look at when drafting a bill or proposition; ‘first do no harm’.</p>
<p>Independents are doing two things that are inexcusable by supporting this proposition. They are supporting a change in the electoral system, only allowing the top two vote getters to make it through to the general election, that has flatly been shown to not accomplish the stated goals of lessening partisanship in the other states and areas that have, or have had, such rules in place.</p>
<p>I am personally quite familiar with these kinds of rules. In my home state of Nebraska, I considered running for state senate, as an independent, myself. This rule was not the only reason I decided not to do so, but looking at a short primary season where I would have had to overcome a huge money, organizational and manpower deficit&#8230; it certainly was one of the straws that broke the camel’s back. Had I had the entire campaign season to catch up, my decision could have been different.</p>
<p>In other words&#8230; we’re hurting our own chances, in trade for a rule that has no history of lowering partisanship, and actually has a track record of lowering the rate of incumbent turnover.</p>
<p>The second mistake is even more insidious, and the reason why I dub this bill the ‘First DO Harm’ Act. The first could be explained away as being duped, misinformed or (at best) perhaps blindly grasping for straws on a gamble. No&#8230; this is wholly deliberate. This is taking a page from the two party duopoly playbook. Its inexcusable and so hypocritical I cringe to think about how it might effect the future of independent movement types should this pass in California.</p>
<p>Independents have been the whipping boy of the political process for the dozen or so years that I’ve been really paying attention to politics. Its terribly hard to have an effect on primary elections, the hurdles to running for office as an independent are disturbingly high in most places and candidates from the two major parties pay attention to us only when races get close.</p>
<p>If there is any group of people that we have some common cause with on electoral reform, its third party organizations. Now, I think that both major parties are far too partisan, and I recognize that organizations like the Green Party and Libertarian Party are even more ideologically extreme in most cases. But my ideological differences with them don’t go so far as to impinge upon my higher conscientious support for basic democratic ideals, and fundamental fairness.</p>
<p>Richard Winger, over at Ballot Access News, hits the nail on the head in his op-ed in the San Francisco Bay Guardian:</p>
<blockquote><p>“&#8230;since minor party candidates almost never place first or second in the June primary, minor party members would never be able to run for statewide office in November. And, the catch is that only the November vote counts for meeting the 2 percent vote test.</p></blockquote>
<p>and&#8230;</p>
<blockquote><p>“The real irony is that the big newspapers of California know about this problem with Prop. 14 but refuse to mention it. That&#8217;s ironic because back in 1981, when Democrats in the Legislature wanted to toughen the ballot-access requirements, the big newspapers of California denounced that bill with full fury. Forty of California&#8217;s biggest newspapers, TV stations, and radio stations editorialized against that measure.</p></blockquote>
<p>lastly&#8230;</p>
<blockquote><p>&#8220;Prop. 14 is supported by the Chamber of Commerce, the for-profit health insurance companies, the for-profit hospitals, and various multimillionaires, and the Yes on 14 campaign has a huge war chest. Why won&#8217;t the L.A. Times even mention this flaw in the measure? Who are the big dailies afraid of offending?&#8221;</p></blockquote>
<p>And who are these independent organizations afraid of offending&#8230; or perhaps who are they pandering to?</p>
<p>This proposition flat out screws the minor parties. This glaring selfishness is made embarrassingly worse by the fact that several independent supporters I have communicated with, or read explanations of their reasoning for support, of the proposition have actually touted this as a way of further marginalizing these minor parties. This rings of a bully at school taking his anger out on even smaller kids because his bigger brothers have been beating on him for years. In fact, this is precisely what this is.</p>
<p>I’m not going to split hairs on this issue. Independents that support this bill should be ashamed of themselves.</p>

So, no more party primaries. And that has folks on both sides up in arms.</p>
<p>Republicans think it would result in general elections where you have Democrat vs Democrat instead of Republicans vs Democrats.</p>
<p>Others are worried that it would mean that whoever spends the most money in the primaries will get the most votes and proceed to the general.</p>
<p>Still others think that this would actually crowd out 3rd parties.</p>
<p>Here&#8217;s what the Center for Governmental Studies <a href="http://www.ballot-access.org/2010/04/30/center-for-governmental-studies-issues-neutral-report-on-prop-14/">found</a> in <a href="https://docs.google.com/viewer?url=http://www.cgs.org/images/publications/cgs_top_two_042810.pdf">their report</a>&#8230;<br />
<blockquote>The Center for Government Studies has issued this 102-page report on California’s Proposition 14, the “top-two” ballot measure on the June 8, 2010 ballot. The study, by Molly Milligan, studies whether Proposition 14 would create more moderate California politicians. The study suggests that the measure would tend to create more moderates in the State Senate.</p>
<p>The study also finds that campaign spending would increase, because many candidates who now have a completely safe primary process would need to spend enough money to win twice before the entire electorate. The study also says, on page 17, in footnote 11, that in the Massachusetts special U.S. Senate election of January 2010, if Massachusetts had used top-two, Scott Brown would not have qualified for the second round. In the real world, Brown won the election.</p>
<p>Finally, the study concludes that there would be a good share of legislative races, and some U.S. House races, in which the November election would be between two Democrats. However, the study does not believe there would be November elections between two Republicans.</p></blockquote>
<p>So what do you think? A good idea?</p>

<blockquote><p>“When the California legislature voted to put Proposition 14 on the ballot this June, it crafted a summary of the initiative which will also appear on the ballot, that accurately described what its effect would be if passed. Opponents of the measure have now gone to court to try to change the summary to frighten voters with misleading statements such as, &#8220;Eliminates political parties&#8217; rights to be on the general election ballot.&#8221;  If they have their way, a measure that expands the rights of voters – most especially the state’s three million independent voters – will be reframed as one that eliminates the rights of parties.  Since an overwhelming majority of Americans are angry about partisan gridlock, now is not the time to protect political parties at the expense of the voters. And California Dems (including the school employees union) are playing some bad language games trying to dissuade voters from supporting <strong>Proposition 14</strong>, the &#8220;Top Two&#8221; open primary referendum on the ballot for a vote in June that will allow independents full participation. <p>This moment from the Massachusetts Senate debate is getting a lot of play:<br />

Gergen served up a softball and Brown knocked it out of the park.</p>

<p>If Brown wins, this may be the moment that put him over the top.  Over <a href="http://www.csmonitor.com/USA/Politics/2010/0112/Will-Republican-Scott-Brown-take-Ted-Kennedy-s-Senate-seat">a million dollars flowed into his campaign coffers</a> in the 24 hours after the debate. The Democratic party establishment took note and sent out <a href="http://theplumline.whorunsgov.com/senate-republicans/internal-memo-to-top-dem-donors-warns-mass-senate-race-is-very-tight-urgent/">a call for cavalry</a>. Of course Big Union is riding to the rescue. But in the meantime, while <a href="http://www.boston.com/news/local/breaking_news/2010/01/union_plans_maj.html">Coakley is measuring the drapes in Washington D.C.</a>, Brown is on the ground in Massachusetts.  </p>
<p>Watching from afar out here on the left coast, I have a hard time believing that Massachusetts would elect a Republican to finish Ted Kennedy&#8217;s term in the Senate.  It seems as unlikely as unseating my Representative Nancy Pelosi or Senator Barbara Boxer in the upcoming mid-terms. Just not a good bet.</p>
<p>There were some interesting insights on this election in the comments to<a href="http://donklephant.com/2010/01/10/scott-brown-nothing-to-see-here/#comments"> Frank&#8217;s post</a> on the race. In terms of prognostications,  I&#8217;ll defer to our man on the ground and <a href="http://donklephant.com/2010/01/10/scott-brown-nothing-to-see-here/#comment-599277">agree with Kranky</a>. The Dems may get a scare, but on election night Martha Coakley will prevail.  As <a href="http://donklephant.com/2010/01/10/scott-brown-nothing-to-see-here/#comment-599301">Nick points out</a>, all this national attention and the tightening polls should serve to motivate the rank and file Democrats to get out the vote.  Excitement about their candidate being heretofore the very thing that is missing from the Democratic campaign. Scott Brown is givng them the gift of <strike>panic</strike> excitement. </p>
<p>That said, Scott Brown is doing some very smart things. Challenging Massachusetts voters to rethink the notion that this senate seat is an entitlement of the Democratic Party was exactly the right thing to do.  In addition, he is soft pedaling the commitment required by voters, noting there are only three years left in the term. Saying in effect &#8211; <em>Just try it out for while. If you don&#8217;t like it you don&#8217;t have to buy.</em>  Very smart salesmanship &#8211; first deal with the objection, then make it easy to sign on the dotted line. </p>
<p>It will still be a miracle if he pulls it off, but if he does I&#8217;ll have to change my prediction for 2010.  Who knows? If the GOP can pick up this seat, four more seems reasonable, and if Joe Lieberman gets tired of his abusive relationship with the Democrats, well, that means a new majority in the Senate in 2011.  </p>
<p>Dare I even dream the impossible dream? Replacing Barbara Boxer with Carly Fiorina? </p>
<p>If Brown can win in Massachusetts, anything can happen. </p>

Arnold Schwarzenegger and legislative leaders announced Monday that they had reached a deal to close California&#8217;s $26.3-billion deficit and begin paying all of the state&#8217;s bills again, potentially ending months of partisan wrangling and a cash crisis that threatens to push California into insolvency.</p>
<p>Their agreement, which could go before the full Legislature within days, does not include any broad-based tax increases, relying instead on deep cuts in government services, borrowing and accounting maneuvers to wipe out the deficit.</p></blockquote>
<p>So what about the elderly and poor? Well, from reading about the following cuts it feels like Schwarzenegger really got his way. </p>
<p>That&#8217;s not to suggest he doesn&#8217;t care about the elderly and poor, but cutting back on social services and allowing off shore drilling is a pretty big cornerstone of current fiscal conservative philosophy&#8230;<br />
<blockquote>Tens of thousands of seniors and children would lose access to healthcare, local governments would sacrifice several billion dollars in state assistance this year and thousands of convicted criminals could serve less time in state prison. Welfare checks would go to fewer residents, state workers would be forced to continue to take unpaid days off and new drilling for oil would be permitted off the Santa Barbara coast.</p></blockquote>
<p>By the way, that little bit about criminals serving less time? The estimates suggest that nearly 20,000 people will be released early. This isn&#8217;t necessarily a bad thing since sometimes more prison time leads to people becoming better criminals. Also, I&#8217;d imagine you could let the non-violent drug offenders go first.</p>
<p>Still, these cuts will hurt, and in a place as massive as California a lot of people can fall through the cracks. Now even more will.</p>

<p>Sure, the global economy has tanked the past couple years and revenues aren&#8217;t coming in like they were, but how can the gap be so vast? Because we&#8217;re not talking a couple billion dollars. This took some doing and I had a really hard time believing this was due to simple revenue shortfalls or excess expenditures on infrastructure, health care, welfare and schools.</p>

<blockquote>California&#8217;s controller said on Wednesday that he would have to issue IOUs in a week if lawmakers can&#8217;t quickly solve a $24 billion budget deficit, and the state&#8217;s treasurer plans to tap a reserve fund to meet debt service costs.</p>
<p>The measures came as a budget crisis deepened in the most populous U.S. state and the gridlocked legislature failed to pass a proposed $11 billion in cuts.</p></blockquote>
<p>Why the gridlock? Because Dems want to makes cuts and raise taxes and Republicans won&#8217;t let them. They say that massive cuts need to be made, and that&#8217;s fair politically, but we&#8217;re getting into some pretty dire territory at this point and I don&#8217;t see how cutting health care and school funding is going to help California in the long run.</p>
<p>But back to the IOU situation&#8230;<br />
<blockquote>&#8220;Next Wednesday we start a fiscal year with a massively unbalanced spending plan and a cash shortfall not seen since the Great Depression,&#8221; Controller John Chiang said in a statement announcing that he would be forced to use IOUs to pay the state&#8217;s bills beginning on July 2.</p>
<p>&#8220;The state&#8217;s $2.8 billion cash shortage in July grows to $6.5 billion in September and after that we see a double digit freefall,&#8221; Chiang said. &#8220;Unfortunately, the state&#8217;s inability to balance its checkbook will now mean short-changing taxpayers, local governments and small businesses.&#8221;</p></blockquote>
<p>They say they plan to solve some part of it by issuing bonds, but that&#8217;s not as surefire as it once was since rating agencies may downgrade them.</p>
<p>No easy answers in this debate, but that&#8217;s where we&#8217;re at right now.</p>

<p>California voters had their say and now Schwarzenegger is doing what needs to be done.</p>

<p>The governor&#8217;s proposal to whack an additional $5.5 billion from state programs stunned even longtime Capitol-watchers with its blunt force. Ending cash assistance for 1.3 million impoverished state residents, for example, would make California the only state with no welfare program. [...]</p>
<p>The governor&#8217;s office reiterated that the cuts were painful but unavoidable, with the proposed budget for the 2009-10 fiscal year already outdated before lawmakers even begin debate. Schwarzenegger&#8217;s finance team now says the deficit will grow to $24.3 billion by July 1, up from the previous $21.3 billion projected shortfall.</p></blockquote>

So why is this happening?</p>
<p>Well, most of what you need to know is in <a href="http://business.theatlantic.com/2009/05/should_we_blame_californias_government_or_its_citizens_for_the_deficit.php">this article</a>. Basically, the blame is shared by both the citizens of CA and the government, and these cuts seem to be the only way to make things right. Spending must be reigned in since any new taxes or tax increases in California have to approved by a 2/3rds majority in both houses, and that&#8217;s an almost impossible feat.</p>

<blockquote>â€œYesterday, the California Supreme Court said that the California Constitution compels the State to discriminate against gay men and lesbians who have the temerity to wish to express their love and commitment to one another by getting married,â€ Olson said. â€œThese are our neighbors, coworkers, teachers, friends, and family, and, courtesy of Prop 8, California now prohibits them from exercising this basic, fundamental right of humanity. Whatever discrimination California law now might permit, I can assure you, the United States Constitution does not.â€ [...]</p>
<p>Todayâ€™s lawsuit argues that the Californiaâ€™s Constitution &#8212; as amended by Proposition 8 &#8212; violates the Fourteenth Amendment of the United States Constitution, a provision with which all state laws must comply. </p>
<p>Relegating gays and lesbians to â€œseparate but unequalâ€ domestic partnerships violates the U.S. Constitution, the suit states. Californiaâ€™s domestic partnership law is not an adequate substitute for access to the Stateâ€™s institution of civil marriage, the suit states, because domestic partnerships do not provide all of the legal and government benefits and protections that marriage does.</p>
<p>â€œMore than 30 years ago, the United States Supreme Court recognized that marriage is one of the basic rights of man,â€ the suit states, referring to the Courtâ€™s decision in Loving v. Virginia, which struck down bans on interracial marriage.</p>
<p>According to the suit, Proposition 8:
<ul>
<li>Violates the Due Process Clause by impinging on fundamental liberties.</li>
<p></p>
<li>Violates the Equal Protection Clause of the Fourteenth Amendment.</li>
<p></p>
<li>Singles out gays and lesbians for a disfavored legal status, thereby creating a category of â€œsecond-class citizens.â€</li>
<p></p>
<li>Discriminates on the basis of gender.</li>
<p></p>
<li>Discriminates on the basis of sexual orientation.</li>
</ul>
</blockquote>
<p><strike>That&#8217;s a lot stronger case than I thought it would be, and maybe they&#8217;re right to challenge this one. But the key difference between <i>Loving v. Virginia</i> and this case is that racial identity is pretty much fixed, while it can be argued that sexual identity is not necessarily. Sure, we make sure folks can&#8217;t discriminate based on sexual orientation, but that doesn&#8217;t infer marital rights to those folks. Of course, then it gets into the idea that bisexuals should be allowed to marry whoever they want, and I&#8217;m obviously fine with that too. But there&#8217;s a difference and it will be brought up.</p>
<p>Also, common sense tells me that if the liberal CA Supreme Court voted against overturning Prop 8 by 6 to 1, does anybody think the US Supreme Court will overturn that? Seems highly unlikely, so they could be handing their opponents a very easy win.</strike> (Note: This case is different than the one the CA Supreme Court just decided. My apologies for the confusion, but it also means their case is MUCH stronger now.)</p>
<p>Regardless, it&#8217;ll be an interesting case and this could be a watershed moment for gay marriage&#8230;one way or another.</p>

<p>Anybody who reads this blog knows where I fall on the gay marriage issue, but the Supreme Court of California wasn&#8217;t <i>reallly</i> deciding the validity of gay marriage itself, so the ruling was actually dead on in my opinion.</p>
<p><a href="http://www.bloomberg.com/apps/news?pid=20601103&#038;sid=aXjgJBirm_0g&#038;refer=us">This article</a> from Bloomberg points out why&#8230;<br />
<blockquote>The court legalized gay marriage a year ago before California voters overruled it in November. Fifty-two percent of them approved the ban, amending the state constitution to recognize only marriages between a man and a woman. The court ruled 6 to 1 today in favor of upholding Proposition 8, saying it was ruling only on the ability of voters to pass a ballot measure rather than whether gay marriage should be legal.</p>
<p>â€œThe principal issue before us concerns the scope of the right of the people, under the provisions of the California Constitution, to change or alter the state constitution itself through the initiative process,â€ the court wrote, â€œnot to determine whether the provision at issue is wise or sound.â€</p></blockquote>
<p>Yes, it&#8217;s the law and it&#8217;s specific. And if they ruled against that provision, it would harm the citizens&#8217; rights to amend the Constitution. That&#8217;s not a precedent the courts want to set just to prove a point.</p>
<p>But here&#8217;s the most important part of this entire argument&#8230;<b>all the marriages that happened before the ban are legal!!!</b><br />
<blockquote>The court ruled unanimously that the 18,000 same-sex marriages performed before the ban remain valid. The November ban sparked protests across California and led activists to create Web sites that identified individuals who donated money to support the measure and boycott donorsâ€™ business. The ballot measure overrode the courtâ€™s May 15, 2008, ruling that laws barring same-sex marriages were unconstitutional. </p></blockquote>
<p>So to all of you gay marriage advocates, I know this seems like a loss today but it&#8217;s not. </p>
<p>Actually, this is a VERY big win as it signals continuous positive movement. Because you know there will be another ballot initiative to overturn Prop 8 at some point and it&#8217;ll pass and California will join the growing number of states where marriage is equal for all. But you have to get out there and fight for it if you want it to happen.</p>

<blockquote>President Obama will announce as early as Tuesday that he will combine that stateâ€™s emissions rules with the existing corporate average fuel economy standard overseen by the Transportation Department, the officials said. As a result, cars and light trucks sold in the United States will be roughly 30 percent cleaner and more fuel-efficient by 2016.</p>
<p>The White House would not divulge details, but environmental advocates and industry officials briefed on the program said that the president would grant Californiaâ€™s longstanding request to implement its tailpipe standards. Thirteen other states and the District of Columbia have said they intend to apply the same rules. That request had been denied by the Bush administration but has been under review by top Obama administration officials since January.</p>
<p>Yet Mr. Obama is planning to go further, effectively issuing a single rule for both fuel economy and emissions that matches Californiaâ€™s strictest-in-the-nation standards.</p>
<p>Under the new standard, the new combined fuel efficiency standard for cars and light trucks will be about 35 miles per gallon by 2016, roughly in line with the California rule. </p></blockquote>
<p>In my mind this is a smart move for many reasons, not the least of which is you diffuse the emissions standards argument immediately. Yes, it will upset states rights&#8217; advocates, but how does it makes sense that a state should be able to determine whether or not certain pollution levels are acceptable or how much mileage cars can have in their locale? </p>
<p>In other words, there are some things that must be mandated by the federal government, and this is one of them. Our long term strategic interests, both for the environment and our dependency on foreign oil, rely on one set of standards across the board.</p>

<p>Today an even bigger figure has taken up the discussion on whether to decriminalize and tax marijuana. California Gov. Arnold Schwarzenegger said it&#8217;s time to at least debate the issue. The Republican governor made it clear that he&#8217;s not for legalizing weed, but he doesn&#8217;t want to be afraid to talk about it.</p></blockquote>
